Privacy Policy
1. Overview
Fleet is committed to protecting the privacy of all individuals whose Personal Information is stored and processed within our BusFlow Pro™ platform. For the purposes of this Privacy Policy, “Personal Information” includes “Sensitive Personal Information”.
Fleet provides the BusFlow Pro™ platform, a bus route planning and transportation management software, to school divisions. Our relationship with each school division is governed by a customer agreement. Accordingly, if you are a current or past educator, student, parent, or guardian, we collect and process Personal Information about you from and on behalf of the applicable school division, in accordance with their instructions and the terms of their customer agreement.
You should review your school division’s privacy policy to understand your school division’s privacy practices, the purposes for which your Personal Information is being collected and processed, and/or contact your school division for more information on their privacy practices, including for access to your Personal Information or to make Personal Information deletion requests. Please see Section 8 of this Privacy Policy for more information about your school division’s responsibilities.
This Privacy Policy describes how we collect, use, and disclose Personal Information in connection with the BusFlow Pro™ platform.
2. Role of Fleet
Fleet acts as a data processor on behalf of school divisions, which remain the Data Custodians and owners.
3. Information Processed
We collect, use, and process Personal Information provided by school divisions, including:
- Student names and other student identifiers;
- Transportation assignments, including bus routes and bus stop locations;
- Parent/guardian contact information, including names, email addresses, and phone numbers;
- Operational transportation data;
- Any other Personal Information that school divisions choose to provide, in accordance with their own privacy policies and the consents they have obtained from educators, students, parents, and/or guardians.
We do not collect Personal Information directly from students.
4. Purpose of Processing
Personal Information is collected directly from the school division. Personal Information is collected for the following purposes (collectively, the “Authorized Purposes”):
- To establish, maintain, and manage BusFlow Pro™ user accounts;
- To provide requested information, products and/or services;
- Deliver transportation services to school divisions;
- Provide routing and scheduling information to school divisions;
- To provide school divisions with the BusFlow Pro™ platform, including, but not limited to providing school divisions with bus fleet reports;
- To comply with applicable legal and regulatory requirements ;
- For other purposes where we have a legal duty or right to do so or where we have a good faith belief that it is necessary to protect our property or rights; and
- We do not collect Personal Information for any other purposes, unless we or the applicable school division have the consent of the individual to whom it relates.
5. Data Sharing
Fleet:
- Does not sell Personal Information
- Does not use Personal Information for marketing
- Does not share Personal Information outside Authorized Purposes
6. Security Measures
Fleet has implemented reasonable policies, procedures, and safeguards (including physical, technological, and organizational measures) designed to protect the security of Personal Information under its control, including, but not limited to:
- Encryption (in transit and at rest)
- Role-based access control
- Multi-factor authentication (for sensitive Personal Information)
- Audit logging
The protection of Personal Information is of paramount concern to us, and we are prepared to take appropriate and timely steps in the event of any incidents involving Personal Information in accordance with applicable privacy laws and our customer agreements with applicable school divisions.
If you are an educator, student, parent, or guardian requests for access to or correction of the Personal Information that we hold about you must be made through the applicable school division.
7. Data Residency
Personal Information is stored in Canada or the United States in compliance with applicable contractual requirements.
8. Retention & Consent
Data is retained only as required or permitted by:
- The school division; and
- Applicable data privacy legislation
Your school division is responsible for obtaining appropriate consent from you for the Personal Information they collect, use, store, transfer, and disclose. If you are a school division, you acknowledge that you have obtained appropriate consents from all educators, students, parents, or guardians for the collection of their Personal Information and the sharing of same with us.
You may choose not to provide us with Personal Information or you may withdraw your consent at any time upon reasonable notice, subject to any legal or contractual requirements. However, without your Personal Information, we may not be able to provide, or continue providing, part or all of the BusFlow Pro™ platform to the school division to which you are associated. Please contact your school division for more information regarding the implications of withdrawing consent.
For greater certainty, your school division is responsible for its own privacy compliance, including managing your consent with respect to the use of the BusFlow Pro™ platform and handling and responding to access to information or Personal Information deletion requests.
